DaoShu Energy 用户协议与免责声明

1. 服务性质声明

文化与咨询性质：DaoShu Energy 提供的所有服务（包括免费扫描、深度分析报告、专家一对一建议）均基于中国传统易经文化与民俗理论。

非专业建议：本服务属于文化咨询与娱乐性质。我们不提供任何形式的房地产估价、法律建议、财务建议、建筑结构评估或心理咨询。

联合免责：专家提供的一对一咨询意见具有高度主观经验性。本协议中的免责及责任限制条款，既适用于 DaoShu Energy (ABN 主体)，也同等适用于参与咨询的个体专家。

2. 服务项目与收费

基础服务：房产外部环境（如路冲等形煞）扫描为限时免费服务。

深度分析报告（$50 澳币 / 案）：仅提供针对特定一套房产及单个人八字的数字化系统自动生成报告。

至尊专家咨询（$500 澳币 / 项）：

• 服务范围：为期 180 天（6 个月）的一对一专家人工服务。
• 服务限额：包含对购房者及其居住成员的能量匹配分析，上限为 15 套房产。

3. 费用与「不可退款」政策

数字产品（$50 报告）：鉴于其数字化交付性质，一旦用户完成支付且系统开始处理，即视为服务已履行。除技术故障导致无法读取报告外，不支持退款申请。

专家人工服务（$500 咨询）：鉴于该服务涉及专家时间成本排期及高度定制的人工劳动，一旦服务开启（即：专家与用户建立联系、或用户提交了第一份测算资料），该服务费即视为全额消耗，在任何情况下均不予退款。

过期与限额：有效期满或房产套数达标后，未使用的额度自动作废，不予折现或退款。

4. 用户提供信息的准确性

报告与咨询的准确性完全依赖于用户提供的出生日期（八字）和房产地址 / 内部结构信息。若因信息输入错误导致的报告偏差，DaoShu Energy 及专家不承担任何修正或退款责任。用户需确保已获得相关居住成员许可提供其个人隐私数据。

5. 责任限制

决策风险：用户基于本平台及专家信息做出的任何买房、卖房、装修或生活决策，其结果（包括经济盈亏或心理影响）由用户自行承担。

损害赔偿限额：在法律允许的最大范围内，DaoShu Energy（及 ABN 持有人）与个体专家对任何索赔的累计赔偿限额，仅限于用户针对该项服务实际支付的金额（即 $50 或 $500 澳币）。

6. 隐私保护与数据使用

我们收集您的生日和房产地址仅用于生成报告与咨询建议。我们承诺不会向第三方泄露您的敏感信息，除非法律强制要求。详见 隐私政策。

7. 第三方链接与平台声明

本平台通过引流方式（如微信）提供的咨询属于用户与专家间的互动。虽然公司与专家共同免责，但用户知悉专家在第三方通讯工具上的互动受该工具服务条款约束。

8. 准据法与管辖权

本协议受澳大利亚南澳大利亚州（South Australia）法律管辖，并依其解释。

1. Nature of Service

Cultural & Consultation Nature: All services provided by DaoShu Energy (including free scans, deep reports, and one-on-one expert advice) are based on traditional Chinese I-Ching culture and metaphysical theories.

Non-Professional Advice: This service is for cultural and entertainment purposes only. We do not provide real estate appraisals, legal advice, financial advice, structural engineering assessments, or psychological counseling.

Joint Disclaimer: Expert consultations are highly subjective. The disclaimers and limitations of liability set forth in this Agreement apply equally to DaoShu Energy (the ABN holder) and the individual experts providing the consultation.

2. Service Packages & Fees

Basic Services: Scanning for external property features (e.g. T-junctions) is a limited-time free service.

Deep Analysis Report (A$50 per case): This digital report is provided exclusively for a single specific property and a single individual's BaZi data.

Premium Expert Consultation (A$500 per package):

• Scope: A 180-day (6-month) one-on-one expert manual service.
• Quota: Includes energy matching analysis for the home buyer and household members, for a maximum of 15 properties.

3. Payment & Strict No-Refund Policy

Digital Products (A$50 Report): Due to the digital nature of the report, once payment is processed and the system commences, the service is deemed fulfilled. No refunds will be issued except as required under the Australian Consumer Law (e.g. technical failure).

Expert Manual Service (A$500 Consultation): Due to the commitment of expert scheduling and highly customized labor, once the service has commenced (i.e. contact is established between the expert and the user, or the user submits the first set of data), the service fee is deemed fully earned and is strictly non-refundable under any circumstances.

Expiration & Quota: Any unused quota after the expiry of 180 days or the completion of 15 properties is void and non-refundable.

4. Accuracy of User Data

The accuracy of reports and consultations depends entirely on the birth data (BaZi) and property information provided by the user. DaoShu Energy and its experts assume no responsibility for discrepancies caused by incorrect input. Users warrant they have obtained consent from relevant household members to share their personal data.

5. Limitation of Liability

Risk of Decision: Any decisions regarding property transactions, renovations, or lifestyle made based on information from this platform or experts are at the user's sole risk. The user assumes all financial and psychological consequences.

Liability Cap: To the maximum extent permitted by law, the total cumulative liability of DaoShu Energy (and its ABN holder) and individual experts for any claim is limited to the amount actually paid by the user for the specific service (A$50 or A$500 AUD).

6. Privacy & Data Use

We collect birth dates and property addresses solely for generating reports and consultations. We commit not to disclose your sensitive information to third parties unless required by law. See Privacy Policy.

7. Third-Party Interaction

Consultations referred through this platform (e.g. via WeChat) are interactions between the user and the expert. While the Company and experts are jointly disclaimed, users acknowledge that interactions on third-party tools are subject to the terms of those tools.

8. Governing Law

This Agreement is governed by and construed in accordance with the laws of South Australia, Australia.
