Terms of Service

Please read these Terms carefully before using the DaoShu Energy website or services. By registering an account or submitting a property for analysis, you agree to be bound by these Terms. If you do not agree, do not use the Service.

1. Overview

DaoShu Energy operates the website at daoshuenergy.com and provides cultural feng shui analysis reports for residential and commercial properties.

These Terms form a legally binding agreement between you and DaoShu Energy, governed by the laws of South Australia, Australia.

2. Nature of the Service

Cultural reference only — not professional advice. Reports are based on traditional Chinese cultural principles (Ba-Zhai / Eight Mansions theory) and fall within metaphysical research for cultural and informational purposes only.

Our reports do not constitute professional property advice, investment advice, financial advice, legal advice, building advice, or any other form of licensed professional advice. They should not be used as the sole or primary basis for any decision to purchase, rent, sell, or develop any property.

3. Eligibility

You must be at least 18 years of age to use the Service. By registering, you represent that you are 18 or older and have the legal capacity to enter into these Terms.

4. Account Registration and Credits

4.1 Account

You must register with a valid email address. You are responsible for all activity under your account. Notify us immediately at support@daoshuenergy.com if you suspect unauthorised access.

4.2 Credits

One credit is consumed per completed analysis report. Credits are non-transferable between accounts. Credits do not expire while your account remains active. If your account is terminated for breach of these Terms, unused credits are forfeited.

4.3 Free Scan

New registrations receive one complimentary analysis credit. This free credit is provided once per person and may not be transferred. We reserve the right to modify or discontinue the free credit offer at any time with reasonable notice.

5. Payments

All payments are processed by Stripe, Inc. (USA). By purchasing credits, you agree to Stripe's terms of service. We do not store your payment card details.

All prices are in Australian Dollars (AUD). The displayed price is the final amount payable. Price changes will not affect credits already purchased.

5.1 GST status

DaoShu Energy is not currently registered for Australian GST (we are below the AU$75,000 annual turnover threshold under the A New Tax System (Goods and Services Tax) Act 1999 (Cth), s 23-15). Accordingly:

  • No GST is included in or added to the displayed price.
  • We do not issue tax invoices in the strict §29-70 GST Act sense. You will receive a standard payment receipt from Stripe by email after a successful purchase, which is sufficient as proof of payment for personal use.
  • Should we cross the GST registration threshold in future, this Policy and the displayed prices will be updated with at least 14 days’ notice to registered users.

5.2 Energy Credits (EC) billing unit

Energy Credits (“EC”) are a platform-internal billing unit used to access specific services on DaoShu Energy. 1 EC = AU$1. Unless required under the Australian Consumer Law guarantees, EC purchases are non-refundable; EC are non-transferable and not redeemable for cash. Purchased EC expire 12 months from the date of purchase; bonus EC (e.g. from referral codes) expire 30 days from issue.

5.3 Referral codes and bonus EC

You may earn bonus EC by referring new users with a referral code. To keep the program fair to everyone, bonus EC is issued only when the referred person is a genuine new user who completes the qualifying action.

Fraudulent or abusive activity will result in forfeiture of any bonus EC obtained through that activity, and may lead to suspension of the referral program for the account. Such activity includes, but is not limited to:

  • Self-referrals (referring yourself, or redeeming your own code on a second account)
  • Creating multiple, duplicate, or fake accounts to claim bonus EC
  • Using bots, scripts, or other automated means to generate referrals
  • Submitting false or stolen contact details for referred users

We will only forfeit or suspend on these specified grounds. This does not affect any rights you have under the Australian Consumer Law.

5.4 Date-Selection Membership (择日会员)

The Date-Selection Membership unlocks the “house / venue facing” (扶山) feature within the date-selection tool for account holders. Before purchasing, you acknowledge and agree to the following:

  • Price: AU$96 (Australian Dollars), a one-time payment. The displayed price is the final amount payable.
  • No auto-renewal: this is not a subscription. It does not automatically renew and no recurring charge is made. To continue after expiry you must make a new purchase.
  • Validity: membership is valid for 365 days from the date of purchase (or from redemption of a membership code). After expiry, the unlocked feature reverts to the standard version.
  • Non-refundable once purchased, except where a refund is required under the Australian Consumer Law guarantees (see section 6).
  • Non-transferable between accounts and not redeemable for cash.
  • Membership codes: DaoShu may issue membership codes; redeeming a valid code grants the same 365-day membership on the terms above.

Membership grants access to a cultural date-selection tool. Its outputs are traditional Chinese metaphysics for cultural reference only and are not professional, financial, medical, or property advice.

6. Refunds and Consumer Guarantees

Your rights under the Australian Consumer Law (ACL) apply to this Service and cannot be excluded by these Terms.

6.1 Statutory Guarantees (ACL)

Under the ACL, you have guarantees that our Service will be provided with due care and skill. Nothing in these Terms limits or excludes these statutory rights.

7. Acceptable Use

You agree not to:

  • Submit addresses you do not have a legitimate interest in analysing
  • Attempt to reverse-engineer, scrape, or automate our Service
  • Use the Service to generate reports for resale without our written permission
  • Submit false, misleading, or fraudulent information
  • Attempt to circumvent credit consumption (e.g. by sharing account access)

8. Intellectual Property

All content on the DaoShu Energy website — including our analysis pipeline, rule engine, visual maps, and branding — is owned by DaoShu Energy. You receive a personal, non-transferable licence to view and download your own reports for personal use only.

You retain ownership of any floor plan images you upload. By uploading, you grant us a limited licence to process the image solely for the purpose of generating your report.

9. Cultural Nature & Limitations

Our reports are based on classical Chinese I-Ching culture, environmental metaphysics, and folk theories. While we strive for accuracy in applying these principles, environmental energy and aura analysis are time-sensitive and subjectively interpreted, and results may vary. We do not warrant that every report will be free of errors.

Reports reflect conditions only at the time of assessment and are for personal cultural reference. They are not the opinion or advice of any human expert unless explicitly indicated.

10. Limitation of Liability

To the maximum extent permitted by law, DaoShu Energy's total liability to you for any claim arising from these Terms or the Service is limited to the amount you paid us in the 12 months preceding the claim.

We are not liable for any indirect, incidental, special, consequential, or punitive damages, including loss of profits, data, or goodwill arising from your use of the Service.

11. Australian Consumer Law

Nothing in these Terms excludes, restricts, or modifies any consumer guarantee, right, or remedy you have under the Australian Consumer Law that cannot be excluded by agreement. If the ACL applies, our liability is limited to resupplying the service or refunding the cost paid.

12. Termination

You may close your account at any time by contacting support@daoshuenergy.com. Unused credits will not be refunded on voluntary closure.

We may suspend or terminate your account for breach of these Terms. In such cases, unused credits are forfeited. We will give you reasonable notice except where immediate termination is required to prevent fraud or harm.

13. Changes to Terms

We may update these Terms. We will notify registered users of material changes by email at least 14 days before they take effect. Continued use of the Service after notice constitutes acceptance of the updated Terms.

14. Governing Law

These Terms are governed by the laws of South Australia, Australia. You submit to the non-exclusive jurisdiction of the courts of South Australia.

15. Professional Services — DaoShu 1v1 Consulting

In addition to our automated analysis, we offer optional “DaoShu 1v1 Consulting” — a paid consultation conducted personally by Master DaoShu (the “Practitioner”). This section sets out terms specific to that service, in addition to the rest of these Terms.

15.1 Nature of the Service

1v1 Consulting is a cultural consultation service grounded in classical Chinese feng shui tradition. It is not real estate, financial, architectural, engineering, legal, medical, or psychological advice. The Practitioner is not licensed under the Land Agents Act 1994 (SA) or any equivalent legislation. You should obtain independent professional advice in those areas before making any decision affected by the consultation. Sections 9 and 11 of these Terms apply equally to material delivered as part of a 1v1 consultation.

15.2 Pricing and Booking

The current fee is AUD $500 per consultation. Booking is arranged by contacting us through the “Contact DaoShu” channels (WhatsApp / WeChat / email); we will confirm scheduling and payment instructions by reply. Payment is processed as set out in §5, and a payment receipt is issued by email.

15.3 Scheduling and Delivery

After booking, we will contact you within 5 business days to schedule the consultation. Consultations are typically delivered by video call and take approximately 45 minutes. A written summary report is delivered by email within 14 days of the live session.

You may reschedule once at no charge with at least 48 hours’ notice. Subsequent rescheduling, or rescheduling with less than 48 hours’ notice, may incur an administrative fee of up to AUD $100.

15.4 Refunds for 1v1 Consultations

15.5 Privacy of 1v1 Sessions

Live sessions are not recorded by us unless you explicitly request a recording in writing. Notes taken by the Practitioner for preparing your summary report are deleted within 90 days of report delivery. The Practitioner is bound by a duty of confidentiality regarding information shared during the consultation, except where disclosure is required by law or reasonably necessary to prevent imminent serious harm.

15.6 Limitation Specific to 1v1 Consultations

Any decision you make based on a 1v1 consultation is your own decision. To the extent permitted by law, our maximum aggregate liability for any single 1v1 consultation is the fee paid for that consultation (AUD $500). This limitation does not apply to liability that cannot be excluded under the Australian Consumer Law.

16. Email Subscriptions

If you opt in to a recurring email from us (currently the weekly DaoShu Mobile recommendation):

  • Free of charge. Email subscription is not a paid service and is independent of any credit purchase.
  • Double opt-in. A subscription is only activated after you click the confirmation link emailed to you, in line with the Spam Act 2003 (Cth).
  • Unsubscribe anytime. Each email contains a one-click unsubscribe link that does not require login.
  • Maximum frequency: at most one email per week per active subscription.
  • For the technical and privacy detail of how we obtain consent, retain unsubscribe tokens, and identify our sender (incl. ABN), see Privacy Policy §15.

17. Platform Announcements & Promotional Messages

From time to time we may send you messages about the Service. These fall into two categories:

  • Service announcements (e.g. maintenance notices, policy updates, information about your account or reports). These are operational and are delivered in-app and, where appropriate, by email to your registered address.
  • Promotional messages (e.g. discount codes, special offers). In-app promotional notices may be shown to logged-in users. Promotional email is only sent to users who have given consent, in line with the Spam Act 2003 (Cth).

In-app messages appear in the “Platform Messages” panel within the contact area when you are logged in. They are one-way notices — you cannot reply in-app; to contact us, use the WhatsApp / WeChat / email channels provided. You may dismiss any in-app message.

Unsubscribe. You can opt out of promotional email at any time via the one-click unsubscribe link in each such email; opting out does not affect essential service announcements. For how we target messages (e.g. by region or usage) and our sender identification (incl. ABN), see the Privacy Policy.
